By accessing our digital banking tools, applying for financial products, or utilizing any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

These Terms apply to all financial products and services offered, including but not limited to checking accounts, savings accounts, credit facilities, and online banking tools. Your continued use of our services constitutes ongoing acceptance of these Terms as they may be modified from time to time.

2. Account Terms and Conditions

2.1 Account Opening and Eligibility

To open an account or access our banking tools, you must be at least 18 years of age, possess valid identification, and meet our creditworthiness standards. We reserve the right to verify your identity, employment status, and financial information through third-party services. Account approval is subject to our internal review processes and regulatory compliance requirements.

2.2 Account Access and Security

You are responsible for maintaining the confidentiality of your account credentials, including usernames, passwords, and security questions. Our online tools provide various access options, and you must notify us immediately of any unauthorized access or suspicious activity. We employ industry-standard security measures but cannot guarantee absolute security of digital transactions.

3. Interest Rates and Fee Structure

3.1 Interest Rate Determination

Interest rates on credit products are determined based on multiple factors including creditworthiness, market conditions, product type, and regulatory requirements. 4. Borrower Rights and Obligations

4.1 Payment Obligations

Borrowers are obligated to make all payments according to the agreed schedule. Payments must be received by the due date to avoid late fees and potential negative credit reporting. We offer various payment methods through our digital banking tools, including automatic payments, online transfers, and mobile banking options. You are responsible for ensuring sufficient funds are available for all scheduled payments.

4.2 Information Accuracy and Updates

You must provide accurate, complete, and current information when opening accounts or applying for credit products. You are obligated to promptly notify us of any changes to your contact information, employment status, or financial circumstances that may affect your account or credit obligations. Failure to maintain current information may result in account restrictions or closure.

5. Default Conditions and Remedies

5.1 Events of Default

Default occurs under any of the following circumstances:

  • Failure to make required payments when due
  • Breach of any covenant or agreement contained in these Terms
  • Providing false or misleading information in applications or account documentation
  • Insolvency, bankruptcy, or assignment for the benefit of creditors
  • Death or legal incapacity of the borrower
  • Material adverse change in financial condition

5.2 Remedies and Collection

Upon default, we may exercise all rights and remedies available under law and these Terms, including but not limited to: acceleration of all outstanding obligations, collection of the full amount due, reporting to credit bureaus, engaging collection agencies, and pursuing legal action. We may also offset amounts owed against deposits in other accounts you maintain with us.

6. Digital Banking and Online Tools

6.1 Service Availability

Our online tools and digital banking services are generally available 24/7, subject to scheduled maintenance and system updates. We strive to provide reliable access but cannot guarantee uninterrupted service. Clients may navigate our platform to access account information, make transfers, pay bills, and utilize various banking features designed to enhance their banking experience.

6.2 Transaction Limits and Restrictions

Daily and monthly transaction limits apply to various online banking functions for security purposes. These limits may vary based on account type, relationship history, and risk assessment. We reserve the right to modify limits or restrict access to certain features based on account activity, security concerns, or regulatory requirements.

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms. We may share information with affiliates, service providers, and third parties as permitted by law and disclosed in our Privacy Policy. You consent to our use of your information for account management, service provision, marketing (where permitted), and regulatory compliance purposes.

We employ reasonable security measures to protect your personal and financial information, but you acknowledge that no system is completely secure. You agree to review our Privacy Policy regularly and understand that it may be updated to reflect changes in our practices or legal requirements.

8. Regulatory Compliance and Disclosures

Our operations are subject to federal and state banking regulations, including but not limited to the Truth in Lending Act, Fair Credit Reporting Act, Equal Credit Opportunity Act, and Electronic Fund Transfer Act. We provide all required disclosures in accordance with applicable law, and you acknowledge receipt of all mandatory notices and disclosures related to your accounts and services.

We may be required to report certain transactions to government agencies and may freeze or restrict accounts based on regulatory requirements, court orders, or suspected fraudulent activity. Your cooperation with such requirements is mandatory and failure to comply may result in account closure or legal action.

9. Limitation of Liability and Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES IS LIMITED TO DIRECT DAMAGES NOT EXCEEDING THE AMOUNT OF FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, BUSINESS INTERRUPTION, OR LOSS OF DATA, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Dispute Resolution and Governing Law

Any disputes arising from these Terms or your relationship with us shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits or class-wide arbitration. This arbitration clause does not apply to individual actions in small claims court or our right to seek equitable relief.

These Terms are governed by the laws of the state in which your account was opened, without regard to conflict of law principles. Any legal proceedings not subject to arbitration shall be brought in the state or federal courts located in that jurisdiction.

11. Modifications and Termination

We reserve the right to modify these Terms at any time with appropriate notice as required by law. Material changes will be communicated through written notice, electronic communication, or posting on our website. Your continued use of our services after such notice constitutes acceptance of the modified Terms.

Either party may terminate the relationship subject to the terms of specific account agreements and applicable law. Upon termination, all outstanding obligations become immediately due and payable, and you must cease using our online tools and services.
